As we have outlined previously, Reese’s House is under attack. We recently found out that the appealing property owner, Rick Abbott, has also filed an appeal in the Superior Court of Cumberland County. He did this because his appeal with the city was filed late. In this appeal, he states that he wants the Superior Court Judge to send the appeal case back to the Millville City Commission to decide. He mentions that his attorney was appointed to the Millville Zoning Board to serve as the Zoning Board Solicitor and that is why he missed the deadline to file a timely appeal.
He also goes on to list similar reasons that he mentioned previously as to why our approval should be revoked. To view the full complaint that he filed in Superior Court, just click here.
We are currently waiting to hear back from the city regarding the hearing that is scheduled for April 4. We requested that the hearing be cancelled entirely due to the appeal being filed late. Additionally, now that the matter has been appealed to Superior Court, that case has jurisdiction and should supersede everything else. We will let you know the status of that case, but please keep updated on our event page for more information.
Additionally, we are currently operating without a land use attorney to represent us in these matters. Our previous attorney had to recuse himself from representation due to a conflict of interest.
